Selling a Home During Divorce, With Both Owners Informed

Clear, even-handed communication with both owners, so decisions are made on the numbers.

Selling a home during divorce

Selling a home during divorce in Scottsdale, Cave Creek or Anthem means two owners, often with different priorities, making one set of decisions about one property. Every choice, from the list price to which offer to accept, needs both signatures. That can feel impossible at a time when agreeing on anything is hard.

A home sale doesn’t fix the hard parts of a divorce. It can avoid adding to them. The way to do that is an agent who treats both owners the same, shares the same information with both, and keeps decisions anchored to the numbers.

How I handle a sale where two people must agree

I’m Valerie Moe, with Keller Williams Realty Sonoran Living. In twenty years, I’ve learned that the calmest person in a difficult transaction often decides how it ends. In a divorce sale, that has to be me.

Both owners get the same updates, at the same time, in writing. When a decision is needed, I lay out the options and what the market and the numbers show, so the choice isn’t about who wants what. It’s about what the facts support.

I don’t take sides, and I don’t give legal advice. Your attorneys or mediator handle the terms of the divorce. I handle the sale, and I keep everyone who needs to know informed.

What the process looks like

  • One plan, agreed in writing. List price, preparation, showing access and how decisions get made, settled before the home goes live.
  • A documented price. Comparable sales and current competition, shared with both owners so the number isn’t a matter of opinion. See how I price a home.
  • Clear communication to both parties. Every update and every offer goes to both owners, and to their attorneys or mediator when they ask.
  • Disclosure done properly. The seller disclosures are completed carefully and on time, so nothing surfaces late in escrow.
  • A steady close. I work with the title company so proceeds are handled as your agreement or court order directs.

When one owner has already moved out

It’s common for one owner to be living in the home while the other has moved. That raises practical questions about showings, repairs and who handles what. We settle those in the plan at the start, so neither owner is surprised and the home stays ready for buyers.

If you’re still deciding whether to sell, keep, or buy out the other owner, I can provide a market-based view of the home’s value to help that conversation with your attorney or mediator. See what your home is worth.

Frequently Asked Questions

Do both owners have to agree to sell?

In most cases both owners on title must sign the listing and sale documents. Your attorney can confirm what applies to your situation.

Who do you represent in a divorce sale?

I represent the sale on behalf of the owners and share the same information with both. I don’t take sides and I don’t give legal advice.

Can you help us decide what the home is worth?

Yes. I can prepare a market-based view of the home’s value from comparable sales and current competition, which you can share with your attorneys or mediator.
